Pokémon MYSTERY DUNGEON ONLINE SWEEPSTAKES OFFICIAL RULES

1. Eligibility. NO PURCHASE NECESSARY TO ENTER OR WIN; PURCHASE WILL NOT IMPROVE ODDS OF WINNING. SWEEPSTAKES OFFERED AND OPEN ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA, EXCLUDING PUERTO RICO, WHO ARE AGE 13 AND OVER. IF YOU ARE NOT A RESIDENT OF THESE AREAS OR FAIL TO COMPLETE YOUR ENTRY IN THE FORMAT DESIGNATED BELOW, YOU ARE NOT ELIGIBLE TO WIN A PRIZE. Nintendo of America Inc. is the sponsor ("Sponsor") of this Pokémon Mystery Dungeon Online Sweepstakes ("Sweepstakes"). Directors, officers and employees of Sponsor, its parent and any of their affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, and immediate family members of each (parents, children, siblings or spouse) and those residing in the same household, whether related or not, are not eligible to enter. All applicable federal, state and local laws and regulations apply. Offer void where prohibited.

2. Disclaimer. No mechanically or electronically reproduced entries will be accepted. Sponsor, its parent company, and any of their respective subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled, distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer or communications related malfunctions or failures; (c) any Sweepstakes disruptions, injuries, losses, or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Sweepstakes.
Entry is limited to one entry per person, per day. Only the first entry received each day of the Sweepstakes from an individual will count; subsequent attempts to enter will be disqualified. In the event of a dispute as to any online entry, the account holder of the e-mail address used to enter will be deemed to be the entrant ("account holder" being the natural person to whom the e-mail address is assigned by the relevant internet access provider). Potential winners may be required to show proof of being the account holder.

3. Sweepstakes Period. The Sweepstakes period shall commence at 12:01 AM Pacific Time on April 23, 2008, and end at 11:59 PM Pacific Time on May 21, 2008 (the "Deadline"). All entries must be received by the Deadline to be eligible to win a prize.

Prizes returned as undeliverable or otherwise not claimed within ten (10) days after delivery of prize notification will be forfeited and will be awarded to an alternate winner. Sponsor will make three attempts to choose an alternate winner. If a winner cannot be deemed after the third attempt, the prize will remain unawarded. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Prizes won by a minor (as determined by the laws of the applicable state of residence) will be awarded to a parent or legal guardian on the minor’s behalf. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

All applicable taxes and any license, destination and delivery charges are the sole responsibility of each winner.

In the event of a dispute about the identity of the entrant, entries made online will be made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.

5. How to Enter. To enter, complete the online entry form provided at www.Pokémonmysterydungeon.com. Automated entries (including but not limited to entries submitted using any bot, script, macro or a promotion entry service), copies, and third party entries, are not permitted and will be disqualified. Limit one entry per person per day.

6. Winner Selection. Prize winner will be determined by a random drawing from all eligible entries, to be held on or about May 28, 2008 by Sponsor. Winner will be notified by e-mail within one week of the drawing. To claim the prize, the winner should follow the instructions contained in their notification e-mail.

7. General.
Winner will be required to complete and return an Affidavit of Eligibility and Release and a W-9 Form (Taxpayer Identification Number and Certification Form) within seven (7) days of receipt before the prize can be officially awarded. In compliance with US Internal Revenue Service regulations, Sponsor will issue a Form 1099-Misc to all winners receiving a prize valued in excess of $600 (USD), which requires disclosure of the winner’s social security number. The winner remains solely responsible for paying all federal and other taxes in accordance with the laws that apply to his or her state of residence. Should a winner be deemed ineligible or fail to return the required forms within the time period allowed, an alternate winner may or may not be selected. Sponsor reserves the right, in its sole discretion, to modify, suspend or terminate the Sweepstakes should the administration or security of the Sweepstakes become compromised. By entering the Sweepstakes, you release Sponsor, its parent and their respective subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damage of any kind arising out of or in connection with the Sweepstakes or delivery or misdelivery, acceptance, possession, use of or inability to use the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

8. Use of Winner’s Name, Likeness, etc. Except where prohibited by law, entry into the Sweepstakes constitutes winner’s permission (and if winner is a minor, winner’s parent or legal guardian’s permission) to use winner’s name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded the prize, except where prohibited by law, winner (and if winner is a minor, winner’s parent or legal guardian) may be required to execute a consent to the use of his/her name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.

9. Affidavit & Release. As a condition of being awarded any prize, winners (and if winner is a minor, winner’s parent or legal guardian) may be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Pokémon Mystery Dungeon Online Sweepstakes Official Rules (“Official Rules”) and a release of liability.

10. Winners List; Rules Request. For a copy of the winners list, send a stamped, self-addressed, business-size envelope between June 1, 2008 and June 30, 2008, to Sponsor at the address listed below. Attn: Nintendo’s Pokémon Mystery Dungeon Online Sweepstakes Winners List. To obtain a copy of these Official Rules, send a stamped, self-addressed business-size envelope to Sponsor at the address listed in item # 12 below, Attn: Pokémon Mystery Dungeon Online Sweepstakes.

11. Miscellaneous. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the United States. Entrants agree to be bound by these Official Rules and by the decisions of Sponsor, which are final and binding in all respects. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Sweepstakes or any entrant’s participation in the Sweepstakes should unauthorized human intervention or other causes beyond Sponsor’s control affect the administration, security or proper play of the Sweepstakes or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Sweepstakes as planned. Entrants who violate these Official Rules, tamper with the operation of the Sweepstakes or engage in any conduct that is detrimental or unfair to Sponsor, the Sweepstakes or any other entrant (in each case as determined in Sponsor’s sole discretion) are subject to disqualification from entry into the Sweepstakes.
